California License SuspensionIn California, the legal system surrounding DUIs has two layers: criminal and Department of Motor Vehicles (DMV). According to California Vehicle Code Section 13350, an individual will immediately have their license revoked if they are convicted of a violation of Vehicle Code Section 23512, which states that driving under the influence is illegal. At the time of your arrest, your license will be suspended or revoked based on the severity of the accused DUI. You have the right to request a Los Angeles DMV hearing within 10 days of receipt of notice of suspension or revocation. Once you pay a reissue fee and the time of the suspension or revocation has passed, you may re-obtain your license.

Some immediate suspensions apply. For example, if your blood or breath alcohol test showed a blood alcohol content (BAC) of 0.08% or more, your license is immediately suspended for four months on the first offense, one year in a second offense or offense occurring within ten years of a prior offense. In addition, your license may be immediately suspended if you refuse to take a blood alcohol content test.
